TTOF GRAND PRIZE RAFFLE OFFICIAL RULES

 

Entry Period: The TTOF 2023 Grand Prize Raffle (the “Raffle”), sponsored by the Texas Trail of Fame (“TTOF” or “Sponsor”), begins on July 1, 2023 at 12:00:01 a.m. Central Time (“CT”) and ends on October 28, at 9:59:59 a.m. CT (the “Entry Period”), during which time all entries must be received in order to be eligible. The computer clock of Sponsor’s President is the official timekeeping device of the Raffle.

Eligibility: The Raffle is open to individuals 18 or over who are legal residents of one of the 50 United States and the District of Columbia. Officers and directors of TTOF and the agents and advertising and promotion agencies of the foregoing, and any other entity that develops, produces, or distributes materials for or related to this Raffle and members of their immediate families (defined for these purposes as including parents, spouse, children, siblings, grandparents, and each of their respective spouses) or households (whether related or not) of any of the above, are NOT eligible to enter or win. By participating in the Raffle, you agree to be bound by these Official Rules and the decisions of the judges which are final.

How to Enter: Individuals may enter the Raffle by legibly printing their name, mailing address, telephone number and email address on a preprinted entry form or official ticket and submitting it to: TTOF 3836 Horizon Drive Bedford, TX 76021 along with an entry fee of $10 for each entry.

All entries become the property of Sponsor and will not be acknowledged or returned.

More than one entry may be submitted with a $10 entry fee for each.

Sponsor reserves the right to disqualify illegible, incomplete, misdirected, late, or falsified entries. Sponsor is not responsible for lost, illegible, incomplete, misdirected, late, or falsified entries, whether or not such circumstances were caused in any way by Sponsor or one of Sponsor’s agents. Sponsor is not responsible for the unavailability or inaccessibility of any transmissions, telephone, mail, or Internet service, or unauthorized human intervention in any part of the entry process or the Raffle.

By entering this Raffle, you acknowledge that the judges, Sponsor, and all other businesses concerned with this Raffle, as well as their respective officers, directors, employees, representatives and agents, do not make, nor are in any manner responsible for, any warranty or representations, expressed or implied, in fact or in law, relative to the quality, conditions, fitness, or merchantability of any aspect of any prize.

Selection of Winners. You have not yet won. One winner will be determined by a random selection from all eligible entries received during the Entry Period. The winner will be eligible to receive the single prize to be awarded for this Raffle. Selection will take place at the close of the 2023 Texas Trail of Fame Induction Ceremony, Saturday, October 28, 2023 on the steps of the Stockyards Exchange Building, located at 131 E. Exchange Ave., Fort Worth, TX 76164. Winner selection will be conducted by the Sponsor, the decision of which is final. By participating, you agree to be bound by the selection of the winner by the Sponsor, which shall be final and binding in all respects. The odds of winning depend on the total number of eligible entries received.

The winner will be identified on premises (at the ceremony) or notified by U.S. Mail, email, telephone and/or overnight courier. The Winner shall be required to execute and return an Affidavit of Eligibility/Release of Liability/Prize Acceptance Form and related documentation, including a W-9 form, within ten (10) days following notification. If winner is not present at ceremony, Sponsor will deliver/send the prize to the winner within sixty (60) days following winner verification and receipt of the above documentation. A winner’s failure to claim the prize or failure to comply with any of the Official Rules will result in disqualification and an alternate winner may be selected. If a winner’s address is incorrect, illegible, or invalid, the winner will be disqualified and an alternate winner may be selected. Sponsor is not liable for awarding the prize to an entrant who has violated these Official Rules.

The winner, by participating in this Raffle, hereby grants the Sponsor the right to use and publish his or her legal name and state of residence online and in print, and/or in any other media, in connection with the Raffle.

In the event of a dispute as to the identity of a winning entrant, the holder of the email account associated with the winning entry at the time of such entry shall be declared the winner. An entrant may only win the single prize awarded in this Raffle.

Prizes: The M S R Price of the prize is $725.00. Henry Repeating Arms is not a participant in and does not endorse, support or sponsor this promotion. The prize will be awarded to the winner selected. The prize cannot be exchanged for cash. The Sponsor reserves the right to substitute a prize of equal or greater value in the event the offered prize is unavailable. No substitution or transfer of prize is permitted except as provided herein. Sponsor is not liable for any damage to the prize occurring during delivery to the winner’s address.
The prize shall be awarded without warranty from Sponsor of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
The winner of the Raffle must meet all Federal & State requirements for possession and is responsible for the reporting, filing and payment of all applicable federal, state, and local taxes and fees on receipt of the prize. The costs for goods or services not specified in these Official Rules are the winner’s responsibility.

Eligibility and Release. AS A CONDITION OF PARTICIPATING IN THIS RAFFLE, ENTRANTS AGREE TO RELEASE AND HOLD HARMLESS SPONSOR, AS WELL AS THE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS AND REPRESENTATIVES OF SPONSOR FROM AND AGAINST ANY LIABILITY FOR ANY INJURY, CLAIM, LOSS, ACTION, DEMAND OR DAMAGE OF ANY KIND ARISING FROM OR IN CONNECTION WITH PARTICIPATION OR ANY ATTEMPT TO PARTICIPATE IN THE RAFFLE OR ANY PRIZE WON, OR THE MISUSE OR MALFUNCTION OF ANY PRIZE AWARDED.

Disputes/Choice of Law: Except where prohibited, each entrant agrees that this Raffle shall be governed by, and construed in accordance with, the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules. Sponsor reserves the right to take such action as it deems necessary to enforce these Official Rules and ensure the fair operation of this Raffle, such as situations in which the Raffle does not operate properly due to technical or other unforeseen circumstances, including without limitation barring entrants who do not comply with these Official Rules, terminating or modifying the Raffle, or modifying without prior notice these Official Rules.
By entering, entrants acknowledge and agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Raffle shall be resolved individually, without resort to any form of class action, and consent to the exclusive jurisdiction and venue of the courts of Tarrant County, Texas.

Any and all disputes, claims, judgments, and awards shall be limited to actual out-of-pocket expenses incurred (if any) in entering this Raffle. You agree as a condition of entering this Raffle that you will not seek, and hereby waive all rights to awards for, attorneys fees, punitive, multiple, incidental, and consequential damages, or any other damages other than the actual out-of-pocket expenses specifically enumerated herein. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

ANY ATTEMPT BY AN INDIVIDUAL TO UNDERMINE THE LEGITIMATE OPERATION OF THE RAFFLE IS A VIOLATION OF CIVIL AND CRIMINAL LAWS AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

Winner’s Name: The winner’s name will be available following the verification of the winner and the awarding of the prize. You may also request a copy of the Official Rules or the name of the winner by sending a self-addressed, #10 business-size envelope to: PO Box 4217 Fort Worth, TX 76164. Indicate “Rules” and/or “Winner,” as appropriate, on the front of your outer mailing envelope, in the lower left-hand corner. All other Raffle inquiries may also be directed to this address.
